Apple asks for stay on Mirror Worlds judgment

updated 03:35 pm EDT, Mon October 4, 2010

Payments could reach as high as $625.5 million

Apple is fighting the outcome of Mirror Worlds' recent legal victory, Bloomberg now says. The company has asked US District Judge Leonard Davis for an emergency stay on the verdict, which could potentially result in a damage payment as high as $625.5 million. Despite earlier uncertainty, Mirror Worlds is believed to be claiming $208.5 million for each infringed patent.

In its stay request, Apple suggests that outstanding issues remain on two of the three patents. Asking for $208.5 million in each instance would also be "triple dipping," the company insists. If Mirror Worlds' win carries through, it will in fact represent the second-biggest jury verdict in 2010; the largest was $677 million awarded against Skilled Healthcare Group, which ultimately settled for $50 million.

Both Apple and Mirror Worlds have been asked submit new legal arguments regarding the damages. Davis is further said to be considering a pre-verdict request from Apple, asking for two of the infringement allegations to be dropped. If granted, the associated damages would also be eliminated.

    Gotta love Apple's lawyer's reasoning:

"The patent sold between parties for 5 million dollars. Therefore, Apple should only have to pay that much, no more."
