Apple escalates patent stand-off with Samsung in Australia

Apple wins injunction, stops sales of Galaxy Tab

Apple has engaged Samsung in the Federal Court of Australia. In an escalation of its ongoing patent dispute with Samsung that is unfolding across several countries across the globe, Apple has successfully reached an agreement that will stop the Samsung Galaxy Tab 10.1 from going on sale in the country. The agreement means that Samsung will not be able to sell its Galaxy Tab 10.1 in Australia until the US lawsuit is resolved, nor will it be able to advertise it. In return Apple has agreed to pay Samsung unspecified damages for lost sales should it lose its case.

Apple's Australian council, Stephen Burley, told a Federal Court justice in Sydney that it believes that Samsung is infringing upon 10 Apple patents with its Galaxy Tab 10.1 including its "look and feel" as well as other touchscreen technologies as used in its iPad. Burley also added that Apple was currently seeking injunctions stopping Samsung from selling the Galaxy Tab 10.1 in other countries as well, without specifying which these were.

Samsung's lawyer countered that the version of the Galaxy Tab 10.1 going on sale in Australia differs to the version on sale in the US. However, the company has agreed to supply Apple with three of its Australian models so that Apple can study the devices.

Justice Annabelle Bennett has scheduled a second hearing on August 29 to review the status of the case in the US and to set a local trial date should that be deemed necessary.

The two companies, partners in the supply chain, are at loggerheads over Samsung's Android-powered devices. Apple argues that Samsung has 'slavishly' copied its designs and even its product packaging. Samsung has retaliated by initiating countersuits against Apple. [via Bloomberg]
