Samsung loses 3G tech claim, Apple in good shape

Apple has won the latest skirmish in its ongoing patent war with Samsung that is currently being waged across 10 countries, according to Reuters. A German court in Mannheim has dismissed Samsung's claim that Apple was infringing on its 3G wireless patents. Samsung responded by saying that the ruling only covers one patent and that the German court has yet to hand down its decision on two additional 3G-related patents.

"We are disappointed that the court did not share our views regarding the infringement by Apple of this specific patent in Germany," said a Samsung spokesman.
"It should be noted that today's ruling relates to only one of several patents asserted by Samsung in the Mannheim court," he added.

According to FOSS Patents' Florian Mueller, the judge presiding over the case believes that while the reasoning of the court was not offered in the determination, it is likely that it had reached one of two possible conclusions. Either Apple's products do not infringe on technical grounds, or that Samsung has exhausted its patent.

Apple has previously asserted in the matter that it uses Qualcomm 3G chipsets and that as Qualcomm has paid a licence to use the technology in its chipsets then Apple should not be required to pay a licence for them either. According to Mueller, if the court has sided with this view, then it is likely that Samsung's remaining 3G-related patents claims will also fail.

While Samsung can appeal the ruling, it has not indicated an intention to do so.
