Apple versus Samsung sales injunction hearing: December 6

September 20 hearing now for Galaxy Tab 10.1 matters


Judge Lucy Koh, overseer of the contentious Apple versus Samsung smartphone patent trial, has set a December 6 court date to make a judgement on Apple's request for a permanent injunction against Samsung's devices found to be infringing. The previously-scheduled September 20 hearing will be used to discuss Samsung's request that the Galaxy Tab 10.1 sales injunction be lifted.

On Monday, Apple listed eight devices on which it is seeking preliminary sales injunctions, and will ultimately file for a permanent sales ban should the motion be granted. Given the magnitude of the preliminary injunction request, Judge Koh believed it "appropriate" that post-trial motions be considered before any sweeping sales ban be considered.

Samsung, facing possible US sales injunctions is talking to carriers about feature removals and workarounds along with design modifications on some of its smartphones in an effort to keep the products available to US customers and sidestep Apple's injunctive filing. It will also pursue appeals and other court remedies against the overwhelming victory scored by Apple in the trial. The eight phones targeted by Apple are Samsung's most popular models that were covered in the case, and are projected to generate $3 billion in annual US sales for the South Korean company.
