Apple, Amazon still without settlement in 'app store' lawsuit

August 19th trial date looms

Apple and Amazon have yet to come to a settlement in the former's lawsuit over the term "app store," notes AppleInsider. The two parties were ordered to try and settle the case in January, but haven't made any progress despite multiple talks. These reportedly include an all-day meeting on May 1st, and a 45-minute phone call on June 14th.

Apple's side of the talks are being managed by B.J. Watrous, the company's main intellectual property attorney. Representing Amazon is assistant general counsel Andrew DeVore.

Amazon is accused of infringing Apple trademarks through use of the term "Appstore" for its Android app marketplace. Amazon, though, argues that the term "app store" is generic, and points out that even former Apple CEO Steve Jobs once publicly used the expression that way. Companies like Microsoft have petitioned the US Patent and Trademark Office to halt Apple attempts to trademark the term.

A trial date has been set for August 19th.
