Nokia handed victory in first stage of ITC complaint against HTC

Complete process leading up to embargoes can take up to another year

The US International Trade Commission (ITC) has given a preliminary ruling, finding against HTC in its battle with Nokia. HTC has been found in violation of a pair of patents that are not standards essential -- US Patent number 6,393,260 on a "method for attenuating spurious signals and receiver," and US Patent number 7,415,247 on a "method and arrangement for transmitting and receiving RF signals through various radio interfaces of communication systems."

The judgement in its entirety will be made public after both parties have redacted sensitive business information. In a statement following the ruling, Nokia claims that it is "pleased that the initial determination of the ITC confirmed that HTC has infringed two of our patents. Local counterparts of one of these are also already in litigation against HTC in London, UK; Dusseldorf, Germany and Rome, Italy. We will reserve further comment until we have had the chance to study the judgment in detail."

Today's ruling by Administrative Law Judge Thomas Pender is an initial determination, which will be reviewed by the full commission within the next four months. Both HTC and Nokia can petition the commission to review the proceedings by Judge Pender. Following the full-panel review, Nokia can seek a product injunction against HTC, which could include HTC's newest flagship phone, the HTC One, amongst several other less-popular handsets.
