Jury sides with Apple in WiLAN patent infringement case

Apple sole defendant to avoid settlement

Apple has won a legal victory in the ongoing patent-infringement lawsuit filed by WiLAN. The latter company had been fighting for damages worth $248 million, however the jury has cleared Apple of wrongdoing and found several of WiLAN's patent claims to be invalid.

"WiLAN is disappointed with the jury's decision and is currently reviewing its options with trial counsel, McKool Smith," WiLAN said in a statement, which was spotted by AllThingsD. "WiLAN does not believe previous license agreements signed related to the patents are negatively impacted by this decision."

Ottawa-based WiLAN had targeted several companies in its original lawsuit filed in 2011, including Alcatel-Lucent, Dell, HP and HTC, among others. The patent holder had accused the defendants of infringing several claims in a patent related to CDMA and HSPA technologies.

WiLAN has been derided as a "patent troll" because of its reliance on litigation and licensing fees as sole sources of income, rather than producing actual products. The company boasts that six of the defendants in the latest suit, save for Apple, agreed to settle out of court.
