Motorola Mobile versus Intellectual Ventures suit ends in mistrial

Trial to be rescheduled, likely in 2015

The long-running smartphone patent court duel between Google's Motorola Mobility and non-practicing entity Intellectual Ventures was declared a mistrial earlier today. A two-week long trial resulted in a hung jury in the Wilmington, Delaware venue, with Judge Sue Robinson making the ruling.

Intellectual Ventures' business model focuses on buying patents and combining them into a large patent portfolio, then licensing these groupings to third parties. It states that a major goal of the group is to assist small inventors' "patent struggles" against larger corporations like Apple, Google, and Samsung.

The vast majority of the company's revenue comes from forcing settlements from companies attempting to avoid trial. Motorola versus Intellectual Ventures is the first suit that the patent aggregator has filed that has been seen before a seated jury.

The chief litigation counsel for Intellectual Ventures said of the ruling that "mistrials are an occasional fact of life, and it is disappointing" nothing that the company was looking forward to a retrial. Motorola declared in a statement that it "continues to believe this lawsuit was based on overbroad patent claims meant to tax innovation."
